Softerflow is a free, volunteer-driven community platform founded in the European Union (Sofia, Bulgaria), with the mission to connect design professionals across Europe and internationally. The Platform organizes online sessions where members present personal, non-commercial work for constructive feedback.

2. Eligibility & Participation

The Platform is open to designers and creative professionals worldwide, with a focus on the European Union. By participating, you confirm that all work presented is:
-Personal and non-commercial.
-Not subject to NDA (Non-Disclosure Agreement).
-Not in violation of third-party intellectual property rights.
‍Participation as a Review Lead is voluntary and unpaid. Review Leads agree to provide respectful, constructive, and non-commercial feedback.

3. Nature of Services

Softerflow is not a consulting service. Feedback is provided in a peer-to-peer and educational spirit, and does not constitute professional advice, certification, or endorsement. Members are solely responsible for how they use or implement feedback received. Softerflow and its Review Leads disclaim all liability for outcomes of projects following feedback.

4. Data Protection & Privacy (GDPR Compliance)

Softerflow processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy laws.
‍Data collected: name, email, LinkedIn profile, submitted project details, and session participation.
‍Purpose of processing: organizing sessions, facilitating feedback, community communications, and showcasing approved work on social media.
‍Data sharing: limited to Softerflow organizers and community channels (Discord, Zoom). We will never sell or transfer your data to third parties for marketing purposes.
‍Data retention: personal data is stored securely and retained only as long as necessary for community participation. You may request deletion at any time by contacting softerflow@gmail.com.
‍Your rights: You have the right to access, correct, delete, or restrict processing of your data, as well as the right to withdraw consent and lodge complaints with your local Data Protection Authority.

5. Data Hosting & Transfers

Our website is hosted on Webflow, which acts as a data processor on our behalf. Webflow servers may be located in the United States or other jurisdictions outside the EU. Data transfers are safeguarded under Standard Contractual Clauses (SCCs) in compliance with GDPR. By using our forms, you acknowledge that your data may be processed outside the EU under equivalent safeguards.

6. Intellectual Property

You retain all rights to the work you present. By presenting your work, you grant Softerflow a non-exclusive, limited license to display, discuss, and (upon your approval) share it on Softerflow’s community platforms and social channels for educational and promotional purposes. You confirm that you have the right to share the work and that doing so does not infringe on third-party rights.

7. Community Conduct

By participating, you agree to:
-Give and receive feedback respectfully and constructively.
-Not use the Platform for commercial solicitation, recruitment, or self-promotion beyond what Softerflow explicitly allows.
-Not share or record sessions without prior written consent from all participants.
-Uphold inclusivity, respect, and non-discrimination within the community.
Softerflow reserves the right to suspend or remove participants who violate these principles.

8. Liability Disclaimer

Softerflow provides services “as is” without warranties of any kind. Feedback is voluntary, subjective, and educational in nature. Softerflow, its founders, and Review Leads are not liable for any damages, losses, or disputes arising from participation in the Platform or use of feedback.

9. Volunteer Participation

Review Leads and community members contribute voluntarily and without financial compensation. Participation does not establish an employment, consultancy, or partnership relationship with Softerflow.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the European Union and the Republic of Bulgaria. Any disputes shall be subject to the jurisdiction of the courts in Sofia, Bulgaria.

11. Changes to Terms

Softerflow may update these Terms from time to time to reflect community needs, legal requirements, or platform changes. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
